Terms & Conditions
These terms and conditions ("Terms") apply to your use of the Scout Aged Care and Retirement Solutions website at www.scoutacrs.com.au (the "Website"). Scout Aged Care and Retirement Solutions is a division of SST & Associates (ABN 73 644 455 550) ("ScoutACRS", "we", "us" or "our").
By using the Website you agree to these Terms. If you do not agree, please do not use the Website.

1. About our services
Scout Aged Care and Retirement Solutions helps people moving into aged care or retirement living — and their families — to downsize, declutter and prepare the family home for sale, and then oversees the sale through a competitive real estate agent tendering process.
The Website describes our services in general terms. Any services we provide to you will be governed by a separate written agreement (such as a letter of engagement or service agreement). If anything in that agreement is inconsistent with these Terms, the agreement prevails.
Â
2. General information only
The content on the Website, including articles, guides and checklists, is general information only. It does not take your personal circumstances into account and is not legal, financial, tax, aged care or property advice.

Decisions about aged care, accommodation payments, the sale of a home and estate planning can have significant financial and legal consequences. We encourage you to seek independent advice from a qualified professional — such as a solicitor, a specialist aged care financial adviser or Services Australia — before acting on any information on the Website.

We take care to keep the Website accurate and up to date, but laws, fees and government rules change. To the extent permitted by law, we do not guarantee that Website content is complete, current or error-free.

3. Real estate agents, referral fees and third-party providers
Property sales are conducted by a licensed real estate agent appointed by the property owner or their authorised representative. We manage the tendering process and act in your interests in overseeing the sale.

Where we introduce or recommend a real estate agent, we receive a referral fee or share of the agent's commission. This does not increase the commission you pay. Details of any such fee will be disclosed to you in writing before an agent is appointed, and agents must also disclose it as required by law.

Decluttering, packing, removalist and similar services are provided by independent third-party providers. We coordinate these services on your behalf, but they are engaged and paid directly by you, and the provider is responsible for performing them. We will help resolve any issues that arise.

4. Enquiries and acting for another person
When you submit an enquiry or information through the Website, you confirm that the information is accurate and that, if it relates to someone else, you have their consent or legal authority to provide it.

If you contact us on behalf of another person (for example, as their attorney, guardian or family member), we may ask for evidence of your authority, such as an enduring power of attorney or guardianship order, before acting on your instructions. Where we have concerns about a person's wishes or capacity, we may need to pause until appropriate authority or advice is obtained.

Submitting an enquiry does not create an agreement for services. Any quote or proposal we provide is an estimate only, unless stated otherwise, and is subject to a signed agreement.

5. Using the Website
You agree not to:
-
use the Website for any unlawful, misleading or fraudulent purpose;
-
submit false information or impersonate another person;
-
interfere with the Website's operation or security, or introduce viruses or other harmful code;
-
attempt to gain unauthorised access to the Website or our systems; or
-
copy, scrape or collect content or personal information from the Website by automated means.
Â
We may suspend or restrict access to the Website at any time, including for maintenance.
Â
6. Intellectual property
All content on the Website — including text, graphics, logos, images, design and downloadable resources — is owned by or licensed to SST & Associates Pty Ltd and is protected by copyright and other intellectual property laws.

You may view, download and print Website content for your own personal, non-commercial use. You must not otherwise reproduce, modify, publish or distribute it without our prior written permission.

7. Testimonials
Testimonials on the Website reflect the genuine experiences of individual clients and partners, published with their permission. They may be shortened for length or edited to protect privacy. Every situation is different, and testimonials are not a guarantee of any particular outcome or sale price.

8. Links to other websites
The Website may link to third-party websites, such as government aged care resources or partner organisations. These links are provided for convenience only. We do not control and are not responsible for the content, accuracy or privacy practices of those websites.

9. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where our liability for failing to meet a consumer guarantee can lawfully be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

10. Limitation of liability
Subject to section 9, and to the extent permitted by law:
-
the Website is provided "as is", and we make no warranties about its availability, accuracy or suitability for any purpose; and
-
we are not liable for any loss or damage (including indirect or consequential loss) arising from your use of, or reliance on, the Website or its content, or from any third-party website or provider.
Â
11. Privacy
Any personal information you provide through the Website is handled in accordance with our Privacy Policy, available at www.scoutacrs.com.au/privacy.

12. Changes to these Terms
We may update these Terms from time to time. The updated Terms apply from the date they are published on the Website. Please check this page periodically.

13. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
